Criminal Department

    The Criminal Division of Brazoria County District Clerk’s Office provides one clerk to each Criminal District Court. These clerks are responsible for keeping causes updated as they are heard in Court, issuing warrants and directives to the jail, accepting and entering pleadings on active cases, and preparing penitentiary packets to be sent with the defendant to the prison upon conviction.

    The employees of the District Clerk's Office may not give legal advice. The Government Code of the Texas Statutes prohibits any employee in this office from giving legal advice:    Sec.81.101.

     In this chapter the "practice of law" means the preparation of a pleading or other document incident to an action or special proceeding or the management of the action or proceeding on behalf of a client before a judge in court as well as a service rendered out of court, including the giving of advice or the rendering of any service requiring the use of legal skill or knowledge, such as preparing a will, contract, or other instrument, the legal effect of which under the facts and conclusions involved must be carefully determined.

    Attorneys

    Effective January 1, 2018:  Attorneys are mandated by the Texas Supreme Court to e-File any and all documents in criminal cases with the Brazoria County District Clerk, except for indictments/complaints.

    Helpful Tips:

    -   Our office does not accept attachments within e-File.  Please file each document as a separate
         lead document.
    -   All exhibits need to be filed directly behind the document it goes with as one PDF.
    -   Our office has a 48 hour turn around to issue subpoenas (excluding weekends, holidays, and
         unforeseen closures).
